Whenever, in the judgment of the Board, the Common Elements require improvements,
repairs or reconstruction costing in excess of Ten Thousand dollars ($10,000.00), adjusted
by the percentage by which Common Expense Assessments have changed between 1985 and the
year in which the Board wishes to make a special assessment, said improvements shall not
be made unless they have been approved by two thirds (2/3) of the votes cast in person or
by proxy at a meeting of the Unit Owners at which a quorum is present. Written notice of
such meeting shall be sent to all Unit Owners at least thirty (30) days in advance and
shall set forth the purpose of the meeting. The Board may incur expenses for improvements,
repairs or reconstruction costing less than ten thousand dollars ($10,000.00), as adjusted
herein, without the approval of the Unit Owners. Notwithstanding any of the foregoing, in
the event of any emergency which could cause damage to the Building or any part (S)
thereof, the Board may expend such sums as are necessary to protect the Building or
part(s). The judgment of the Board in exercising its discretion hereunder shall be final.
When any approval required hereunder has been obtained, all Unit Owners benefiting from
any amounts expended hereunder shall be assessed for the cost thereof as a Common Expense.
The due date(s) of any special assessment, or any installment(s) thereof, shall be fixed
in the resolution authorizing such special assessment.
